JUSTICE SHIVAJI PANDEY ORAL ORDER 09-07-2015 Heard learned counsel for the petitioner and the State. In this case, petitioner is seeking bail in Brahmpur P.S.Case No. 146 of 2014 registered u/s 366A/34 IPC. Allegation has been made that the daughter of the informant, namely, Kajal Kumari @ Bulbul aged about 14-15 years went to the Bazar for purchasing medicine but she did not return and after some time, informant received information that accused Guddu Ojha @ Manoj Ojha in connivance with other accused, including the petitioner kidnapped the victim girl for the purpose of marriage. Petitioner aged about 65 years and since 2-3 years she is residing at Delhi for treatment. There is no specific allegation against the petitioner.
Looking to the facts and circumstances of the case,
Patna High Court Cr.Misc. No.17900 of 2015 (3) dt.09-07-2015 2/2 petitioner Maya Devi @ Maya Ojha, on surrender within six weeks from to-day, is directed to be released on anticipatory bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in Brahmpur P.S.Case No. 146 of 2014, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
