JUSTICE ARUN KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Learned counsel for the petitioner submits that cognizance has been taken against the husband under Section 498A of the Indian Penal Code in connection with Nawada P.S. Case No.202 of 2012 but now the situation has changed as husband and wife both have compromised before the Mediation Centre while the matter was referred in connection with another Cr. Misc. No.4841 of 2013.

Mr. Pramod Rajpati, learned counsel appearing on behalf of opposite party no.2 concedes that amicably the matter has been compromised between the parties.

Having considered the aforesaid facts as also the fact

No.19326 of 2014 (5) dt.07-07-2017 2 / 2 that compromise has already reached between the husband and wife and it is not expedient in the interest of justice to continue the proceeding in connection with Nawada P.S. Case No.202 of 2012, arising out of Complaint Case No.340 of 2012, pending before the learned Chief Judicial Magistrate, Nawada and accordingly, the entire criminal proceeding is set aside.

This quashing petition stands allowed.
