====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 15-10-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Phulwariya P.S. Case No. 45 of 2025, registered for the offences punishable under Sections 80(2), 61(2) and 3(5) of the B.N.S., 2023.

3. The petitioner is the husband of the deceased. He is alleged to have killed the deceased and is in custody since 14.05.2025.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the case. It is further submitted that the petitioner has no involvement in the killing of the deceased and that the child born out of the wedlock of the petitioner and the deceased is

5. Learned A.P.P. for the State vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Begusarai/ concerned Court below in connection with Phulwariya P.S. Case No. 45 of 2025 subject to the condition:- (i) However, before accepting the bail bond, the court below shall verify whether the children of the deceased are actually residing with the petitioner's family. In case the verification report is found to be otherwise, the bail bond shall not be accepted and the order of bail shall stand cancelled. (Sandeep Kumar, J) Neha/- U T
