JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 25-08-2023 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State. The petitioners has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 379, 448, 504, 506, 34 of the Indian Penal Code.

As per prosecution case, the allegation against the accused persons including the petitioners is that they armed with various weapons came and started assaulting the informant and when his grandson came to save him then all accused persons also assaulted him by means of lathi danda

Patna High Court CR. MISC. No.51428 of 2023(2) dt.25-08-2023 2/3 and iron rod due to which he sustained injuries. It is further alleged that after assaulting they also took away golden chain of his grandson worth Rs. 30,000/- as well as mobile phone and other articles.

Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to previous land dispute. There no specific allegation of assaulting levelled against the petitioners rather general and omnibus allegation levelled against them. There is case and counter case between the parties and both parties have sustained injuries in separate occurrence. It is further submitted that the petitioners are languishing in judicial custody since 13.05.2023.

Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are

Patna High Court CR. MISC. No.51428 of 2023(2) dt.25-08-2023 3/3 directed to be released on bail in connection with Singheshwar P.S. Case No. 265 of 2020 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura.
