The petitioner is apprehending arrest in a case registered for the offences punishable under Section 307/34 of the Indian Penal Code and 27 of the Arms Act. The accusation is of causing injury to the informant by fire arms.
It is submitted by learned counsel for the petitioner that during investigation it transpired that the petitioner was not present at the place of occurrence. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Patna High Court Cr.Misc. No.15864 of 2015 (2) dt.16-04-2015 2/2 Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Assaon P.S. Case No.54 of 2014, pending before the Chief Judicial Magistrate, Siwan. With the above observation, this application is, accordingly, disposed off.
