Mr. Sri Iftekhar Mahmood ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 02.06.2018, seeks bail in connection with Agion(G) P.S.Case No. 110 of 2017 registered under Sections 307, 323, 341, 504 and 506/34 of the Indian penal Code and 27 of the Arms Act.
The specific accusation against the petitioner, on trivial issue i.e., for fixing of T.V. cable, shot at the informant and other family members from rifle causing firearm injury to the daughter of the informant.
Learned counsel for the petitioner submits that petitioner had no intention of taking away anyone's life as he fired in the air and petitioner has no criminal antecedent. So considering the facts and circumstances of the case, presently the prayer of bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same preferably within nine months. If trial does not get concluded within stipulated period the petitioner may renew his prayer of bail.
