The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363, 365, 34, 376 of the Indian Penal Code and Sections 8, 12 of the Protection of Children From Sexual Offences Act.

It is alleged against the petitioner and 4-5 unknown miscreants that they have abducted the minor girl of the informant.

No.62435 of 2021(4) dt.08-08-2022 2/3 It is submitted by learned counsel for the petitioner that there is no eye witness to the occurrence and his name has been sprang up only on the basis of suspicion. The petitioner and the informant are next door neighbour and are inimical with each other from before. Learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for anticipatory bail of the petitioner and submitted that the victim in her 164 Cr.P.C statement has specifically alleged against this petitioner that he along with 2-3 unknown miscreants came to her house and sprinkled spray, as a result of which, she became unconscious and when she regained consciousness, she found herself in Delhi. She further alleged that this petitioner established physical relationship with the victim without her consent. Considering the fact that the victim in her 164 Cr.P.C statement has specifically alleged against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
