2. The petitioners are apprehending their arrest in connection with Belari P.S. Case No. 19 of 2025 dated 11.07.2025 registered for the offences punishable under Sections 126(2), 115(2), 118(1), 117(2), 109(1), 74, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.
3. As per the prosecution case, the petitioners are alleged to be the members of an unlawful assembly, pursuant to which all the accused persons assaulted the informant, whereafter, the co-accused Jitan Mahadeo and Sahdeo fired by

No.50206 of 2026(2) dt.29-07-2026 2/3 their three-nuts, while the co-accused Alok Kumar and Saurav Kumar also assaulted on his head, while the co-accused Deepak, Pankaj and Shiva came running with latthi and took gold earrings worth Rs. 50,000/- from the neck of the informant, while co-accused Mahendra, Sachendra and Rajendra pointed threenuts to the informant, when the informant's elder brother-in-law (Bhaisur) reached there to save her then all the accused persons also assaulted him with lathi and threatened with dire consequences.

Learned counsel for the petitioners has submitted that there is general and omnibus allegation of assault against the petitioners, while allegation of specifically assaulting the informant and other injured persons are against the co-accused persons. It has further been submitted referring to the impugned order that petitioners were not sent up for trial as the case was found not true against them during the course of investigation but, the learned Additional Chief Judicial Magistrate-III, Madhepura took cognizance against the petitioners and hence the petitioners apprehend their arrest. It has lastly been submitted that the petitioners has got no criminal antecedent.
5. Learned counsel for the State has vehemently opposed the prayer for anticipatory bail of the petitioners.

6. Heard the learned counsel for the parties and perused the record.
7. Considering the aforesaid facts and circumstances of the case as well the fact that there is general and omnibus allegation against the petitioners, while the petitioners were exonerated after investigation, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 10,000/- (Rupees Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Court Additional Chief Judicial Magistrate-III, Madhepura in connection with Belari P.S. Case No. 19 of 2025, subject to conditions as laid down under section 482(2) of the B.N.S.S.
8. The application stands allowed.
