The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 32 of the Bihar Prohibition and Excise Act, 2016. As per the prosecution case, 16.5 litres of liquor was recovered from the house of the petitioner in presence of his uncle Markandey Singh. The petitioner managed to escape. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from his possession or his house. He is in custody since 7.8.2021.

No.61679 of 2021(3) dt.25-04-2022 2/2 Having heard learned counsel for the parties and taking into consideration the facts of the case, recovery of 16.5 litres of liquor from the house of the petitioner in presence of his uncle together with the antecedent of the petitioner under the Bihar Prohibition and Excise Act, 2016, the Court is not inclined to enlarge the petitioner on bail and the application is rejected. Liberty is granted to the petitioner to renew his prayer for bail on completing one year in custody.
