ANJANA MISHRA ORAL ORDER 18-09-2015 Heard learned counsel for the petitioners and learned counsel appearing for the State.
Petitioners apprehend their arrest in connection with Raghopur P.S.Case No.199 of 2013 registered for the offence under Sections 283, 291, 188, 334 and 420 of the Indian Penal Code and Section 3 of the Prevention of Damage of Public Property Act, 1984.
Learned counsel for the petitioners submits that the allegation made against them is general and omnibus that they used to come to the marketing place to collect money from the shopkeepers and also from the vehicle owners passing through the said market without any authority.
It is submitted on behalf of the petitioners that the names of these petitioners have been brought into the present case because of dirty village politics and also because that there was a political rivalry between the Ex-Mukhiya and the present petitioners.
Considering the aforementioned facts and circumstances
of the case, let the above named petitioners be released on bail in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Birpur, District- Supaul in connection with Raghopur P.S. Case No.199 of 2013 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
