JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 30-01-2023 Learned counsel for the petitioner submits that he has filed the application under Order 41 Rule 5 with Section 151 C.P.C. before the Appellate Court in Partition Appeal No. 9/2019 but the said application has not been decided by the Court till date despite the hearing on the said application. Accordingly, he prays to dispose of this Miscellaneous Application with direction to the learned Appellate Court to dispose of the same.

In view of the submission of the learned counsel for

Patna High Court C.Misc. No.618 of 2022(3) dt.30-01-2023 2/2 the petitioner, the Appellate Court is directed to decide the said application expeditiously in accordance with law preferably within six weeks after receiving/producing the copy of this order.
