2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 324, 307/34 of the Indian Penal Code.
3. As per allegation in the FIR, two accused persons including the petitioner, came to the informant armed with sharp weapon and petitioner stabbed her husband.
4. It is submitted by learned counsel for the petitioner that petitioner gas been falsely implicated in this case. Petitioner is an old man of 80 years and he has no intention to cause harm to the informant. There is no allegation of repetition of giving knofe blow. Similarly situated other accused person, namely, Bharat Shukla, has already been enlarged on bail by this Court
Patna High Court CR. MISC. No.54488 of 2023(2) dt.29-08-2023 2/2 passed in Cr. Misc. No. 50200 of 2023 by order dated 11.8.2023. Petitioner is languishing in judicial custody since 22.5.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJM XVI, Vaishali, Hajipur in connection with Tisiauta P.S. Cae No. 46 of 2023.
