JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-04-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 307/379 and other ancillary sections of the Indian Penal Code. As per the prosecution case, the petitioner assaulted the husband of the informant with farsa on his head causing grievous injury.

Learned counsel for the petitioner submits that the petitioner is brother of the informant's husband and there was no intention to hurt him. He submits that there is land dispute between them and on the issue of construction of a toilet tank incident took place on the spur of moment. Petitioner has claimed clean antecedent and he is in custody since 12.8.2021. Investigation is complete.

Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, West Muzaffarpur in Paroo Police Station Case No. 215 of 2021/GR No. 2087 of 2021.
