JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER 16-12-2016 The learned counsel appearing on behalf of the petitioner submits that with respect to the issues raised on behalf of the petitioner in the present writ petition Ceiling Revision Case No.141 of 1993 filed on behalf of the full sisters of this petitioner is still pending before the Board of Revenue, Bihar, Patna. Therefore, he seeks leave of this Court to withdraw the present writ petition with a liberty to intervene in the aforesaid pending revision case before the Board of Revenue, Bihar, Patna. Leave is granted.
The writ petition stands disposed of as withdrawn with the liberty aforesaid.
This is clarified that this Court has not gone into the merits of the claims raised on behalf of the parties with respect to the issues raised in the present writ petition and this is left to be decided by the revisional authority in accordance with law.
Patna High Court CWJC No.6071 of 2015 (3) dt.16-12-2016 It further goes without saying that, the parties shall be at liberty to raise all the issues of facts and law, which may be available to them, before the Board of Revenue, Bihar, Patna in the aforesaid pending Ceiling Revision Case.
