JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 948[C]/2017, disclosing offences under Sections 406, 409, 420, 465, 468, 323, 341, 504, 506, 420 and 120[B] of the Indian Penal Code. Petitioner happens to be the salesman in the company of complainant, who used to make delivery of articles door to door and allegation against him is that he has not deposited the money to the tune of Rs. 1,85,000/-, which were collected after delivery of goods.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case only after he parted with the complainant and started his own business.

Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the basis of materials available on record, without being prejudiced by this order.
