The petitioner seeks bail in a case instituted for the offences under Sections 392 and 364 of the Indian Penal Code. Prosecution allegation, in short, is that the brothe rof the informant was missing along with his vehicle. It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.9.2017 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not named in the F.I.R. The car in question has already been recovered. The name of the petitioner has transpired on the basis
Patna High Court CR. MISC. No.56542 of 2019(3) dt.26-09-2019 2/2 of confession of co-accused. Other co-accuseds have been granted bail vide Annexures- 2, 3, 4 and 5 to the application. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Sherghati, Gaya in connection with Barachatti P.S.
