2. Counsel for the petitioner submits that the present writ petition has been filed for issuance of writ in the nature of mandamus directing the respondents to grant the benefits of ACP under the Scheme of 2003 to the petitioner.

3. Counsel for the petitioner submits that the petitioner is in service on Class IV employee with Land Acquisition Department joined on 14.08.1991 for more than 33 years of continuous service, but no any benefit of ACP has been granted till date.

4. Counsel further relied on the judgment of this Court which is annexed as Annexure-P/1 passed in C.W.J.C. No.12139 of 2010.

5. Counsel for the State submits that the Government of Bihar has framed a rule i.e., the Bihar Government Servant Grievance Redressal Rules, 2019 under which the petitioner ought to file his/her representation/complaint before the Service Grievance Redressal Officer.

6. In this view of the matter, the present writ application is hereby disposed off, granting liberty to the petitioner to file her complaint under the Bihar Government Servant Grievance Redressal Rules, 2019 and the concerned authority is directed to pass the order about the entitlement of the petitioner and if she found entitled, then pass order for payment within 90 days from the date of production of the order along with representation.

7. With the aforesaid direction, the present writ application is hereby disposed off.
