The petitioner seeks bail in a case registered under Sections 341, 323, 324, 308, 504/34 of the Indian Penal Code. The prosecution case in short is that on the petty issue, a dispute took place and in consequence thereof, the accused persons started abusing the informant and his wife. On protest, the informant was assaulted by the accused persons. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 29-03-20198. Charge sheet has already been submitted. For the trivial reason, the alleged occurrence is said to have taken place. The petitioner had no

Patna High Court CR. MISC. No.49041 of 2019(2) dt.07-08-2019 2/2 intention to cause injury to the victim. The alleged occurrence is said to have taken place in a spur of moment. It has further been submitted that the petitioner may be released after completion of five months in custody.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that after completion of five months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Chandan (Anandpur) P.S. Case No. 155 of 2017.
