JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 323, 324 and 307 of the I.P.C. and Section 27 of the Arms Act.
The prosecution story, in brief, is that on the alleged date and time of occurrence when the informant was coming after casting his vote, the accused persons including the petitioner told to kill him. Thereafter co-accused Upendra Paswan and Rajendra Paswan fired from their gun, which him in the thumb of his left hand and both thigh but anyhow he managed to escape. The injured was taken to the Magadh Medical Hospital by his family members for treatment.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.28946 of 2016 (4) dt.06-09-2016 the petitioner is in custody since 6.10.2015 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation is against the co-accused, namely, Upendra Paswan and Rajendra Paswan. No overt act has been alleged against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Gaya in connection with Paraiya P.S. case No.12 of 2000.
