JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code.

No doubt, petitioner is named in the first information report but no specific overt-act has been attributed against the petitioner and it were other accused, who assaulted the informant and others. Moreover, petitioner is in jail custody since 08.04.2016 without having any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with

Patna High Court Cr.Misc. No.25351 of 2016 (3) dt.20-06-2016 2/2 two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in connection with Halsi P.S. Case No. 31 of 2016.
