Petitioner seeks bail in Durgawati P.S. Case No.18 of 2019 registered under Section 392 of the IPC. The owner-cum-driver of the truck lodged the case for robbery against four unknown persons.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner surfaced in the case in the confessional statement of co-accused Vinit Kumar @ Golu. The petitioner was remanded in this case on 04.05.2019 and since then the petitioner is in jail, but the petitioner has not been put on T.I.P. Nothing has been recovered from possession of the petitioner. Similarly situated co-accused Mohit @ Shivam Kumar Singh has already been enlarged on bail by order dated 05.08.2019 passed in Cr.Misc.No.47297 of

Patna High Court CR. MISC. No.48754 of 2019(4) dt.16-11-2019 2/2 2019.

Having considered the facts that the petitioner is not named in the F.I.R. and the petitioner was remanded in this case on 04.05.2019 and the fact that the name of the petitioner surfaced in the case in the confessional statement of co-accused but the petitioner was not put on T.I.P., the prayer of regular bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(rupees ten thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Kaimur at Bhabua in connection with Durgawati P.S. Case No.18 of 2019.
