The petitioner is languishing in custody since 22.02.2016 in a case registered for the offences punishable under Sections 25 (1-B) A and 26 of the Arms Act.

One double barrel gun and four live cartridges are said to have been recovered from the house of the petitioner. Learned counsel for the petitioner submits that the aforesaid recovery was not made in presence of the petitioner rather it was made from the house of other person. Patna High Court Cr.Misc. No.27233 of 2016 (3) dt.05-09-2016 Sahkund P.S. Case No. 109 of 2003, the petitioner does not have any criminal antecedent. Petitioner is in jail custody since 22.02.2016.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Bhagalpur in connection with Sahkund P.S.
