JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 406, 420, 504, 506 of the Indian Penal Code.

As per the prosecution case, on 18.04.2021 on physical verification of the goods of his godown the informant came to know that 123 cartoons of Marry Gold biscuit, 100 cartoons of Good Day biscuit and 140 cartoons of Dettol shop worth Rs. 4,84,051/- were missing and it is alleged that this petitioner has misappropriated the goods.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that petitioner was associated with the

No.61328 of 2021(2) dt.11-07-2022 2/2 informant for last 9-10 years but during that period there is no any complaint against this petitioner which shows the bonafide of the petitioner. It is further submitted that due to enhancement of salary and some other issued scuffle took place between the petitioner and the informant and for that petitioner has been implicated in this false case. No chit of paper has been annexed by the informant in support of his allegation. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Town PS case No.346/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
