The petitioners seek bail in Atri P.S. Case No. 52 of 2017 instituted for the offence under Sections 302, 201 and 120B of the Indian Penal Code.

Counsel for the petitioners submits that petitioners have been arrested merely on suspicion with allegation that they were also involved in disposing of the dead body along with Tapeshwar Yadav, father of the deceased, and others. Counsel for the petitioners further submits that Tapeshwar Yadav has already been granted bail by a coordinate Bench of this Court vide order dated 29.08.2018 passed in Cr. Misc. 36978 of 2018. Petitioners are said to be in custody since 16.03.2018

Patna High Court Cr.Misc. No.49791 of 2018 (2) dt.01-10-2018 2/2 and 06.04.2018 respectively.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya, in connection with Atri P.S. Case No. 52 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioners.
