The petitioner seeks bail in connection with Bochahan P.S. Case No. 333 of 2019 instituted for the offences under Sections 272, 273 and 120B of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

Approximately 1900 litres of liquor is said to have been recovered from the two vehicles parked by the side of

Patna High Court CR. MISC. No.61426 of 2021(2) dt.26-05-2022 2/3 a pond from where persons were also arrested. The petitioner is being prosecuted in this case on the basis of the information provided to the police that he had participated in the loading and unloading of the consignment of liquor.

The learned counsel for the petitioner has submitted that because of his alleged involvement in two other cases of similar nature in which he is on bail, he has been made accused in this case also.

It has further been submitted that some of the other accused persons of this case have been granted anticipatory bail by different Benches of this Court. The petitioner is in custody since 16.08.2021. Regard being had to the nature of accusation against the petitioner and his period of custody, he is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Bochahan P.S. Case No. 333 of 2019.
