Mr. Dilip Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 10-08-2018 Heard learned counsels for the petitioner and the State. Petitioner, already in custody, seeks bail in connection with Ahiyapur P.S. Case No.345 of 2018 registered under Section 409/34 of the Indian Penal Code.

Accusation is that the petitioner introduced to informant to Nawlesh Kumar Choudhary, Managing Director of Nandlal & Company Product Pvt. Ltd. and on faith, entered into an oral agreement with the company for supplying refined oil worth Rs. 6,42,915/- and pursuant to that informant paid in advance Rs. 2,51,000/- but despite several reminders, refine oil was not supplied even after giving assurance.

Learned counsel for the petitioner submits that petitioner is only staff of Nandlal & Company Product Pvt. Ltd. and the Managing Director of the company is Nawlesh Kumar

Patna High Court Cr.Misc. No.49662 of 2018(2) dt.10-08-2018 2/2 Choudhary and advance money was paid to the Company. The petitioner has neither received money nor he has any liability to supply the refined oil that lies with the Managing Director of the Company.

Having considered the aforesaid facts and circumstances, petitioner Manjesh Kumar Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S. Case No.345 of 2018.
