JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-07-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Muffasil (Munger) P.S. Case No. 96B of 2011(Suppl.), registered under Section 147, 148, 149, 342, 323, 302, 387 and 386 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that 13 persons named in the F.I.R., including the petitioner, and 15 to 20 unknown persons surrounded the informant and entered into his Khalihan, where Maheshwar Singh, Manu Yadav, Manish Yadav and Pampam Singh opened fire on the Bipin Yadav, whereas deceased Randhir Yadav is said to be carried by the petitioner and others, later on, whose dead body was found.

Patna High Court Cr.Misc. No.27589 of 2016 (2) dt.11-07-2016 2/2 Learned counsel for the petitioner submits that there is no specific overt act against the petitioner causing injury to the deceased. Further submission is that similarly situated coaccused Naim Khan @ Md. Naim Khan, Ram Gulam Yadav and Pampam Singh have already been granted privilege of bail by a co-ordinate Bench of this Court vide order dated 20.05.2016, 30.06.2016 and 28.07.2015, respectively passed in Criminal Misc. No. 21488 of 2016, Criminal Miscellaneous No. 18821 of 2016 and 2154 of 2015, respectively. The petitioner is in custody since 01.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil (Munger) P.S. Case No.96B of 2011 (Suppl.).
