The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 406, 420, 34 of the Indian Penal Code.

As per the prosecution case, after taking ornaments, utensils and cash of Rs. 2,50,000/-, petitioner no. 2 refused to marry with the complainant. Petitioners returned cash of Rs. 1,79,000/- to the complainant and rest amount was not given. It is submitted that the entire amount taken by the petitioners has been returned to the complainant which is apparent from the FIR itself. It is next submitted that after that a

No.52000 of 2022(2) dt.19-12-2022 2/2 panchayati was held and after preparation of Panchnama, this false and fabricated case has been lodged only with a view to harass the petitioners. Petitioners claim clean antecedents. Considering the facts aforesaid, the petitioners abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 2nd Class, Bhojpur at Ara in connection with Complaint Case No. 1166(C) of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
