JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is named in the First Information Report with allegation that he along with others went to the house of the deceased and took him from his house and thereafter, the petitioner and some others caught the deceased whereas one co-accused opened fired on the deceased as a result of which the deceased died.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined

Patna High Court Cr.Misc. No.25672 of 2016 (2) dt.21-06-2016 2/2 to release the petitioner on bail and hence, his prayer for bail in connection with Barauni (Chakiya) P.S. Case No. 76 of 2016 pending in the court of learned Chief Judicial Magistrate, Begusarai, stands rejected.
