JUSTICE DINESH KUMAR SINGH ORAL ORDER 21-05-2015 Heard learned counsels for the petitioner and the State. The petitioner being the PDS dealer is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

It is alleged that 14 bags of rice from Maxima and 3-3 bags of wheat from two bicycles were recovered by the Circle Officer, Ramnagar, the persons carrying wheat on their bicycles disclosed that they were taken the same from the PDS shop of the petitioner.

It is submitted by learned counsel for the petitioner that no recovery has been made from the petitioner. Subsequently, the stock of the petitioner was also verified by the SDM, Bagaha and except minor irregularities everything was found in order. A statement has been made in paragraph 3 of the petition that the

Patna High Court Cr.Misc. No.22019 of 2015 (2) dt.21-05-2015 2/2 petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Ram Nagar P.S. Case No. 275 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
