====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 14-08-2018 Heard learned counsels for the petitioner and the State.

Petitioner seeks bail in connection with Gopalganj Town P.S. Case No. 295 of 2018 registered for the offence punishable under sections 381 and 120B of the Indian Penal Code to which Sections 411, 409, 420, 379, 413 and 414 I.P.C was added later on.

Learned counsel appearing for the petitioner submits that the present F.I.R has been lodged by this petitioner only but under misconception he has been implicated in this case merely because he is the Principal of the school in question. After lodging this F.I.R. he also informed the District Education Officer, Gopalganj and Examination Controller, Bihar

Patna High Court Cr.Misc. No.50178 of 2018(2) dt.14-08-2018 2/2 School Examination Board, Patna intimating about the action taken in connection with theft of answer sheets, which shows bonafide on his part. Petitioner having no criminal antecedent and is in custody since 26.06.2018 and is at the verge of his retirement.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Gopalganj Town P.S. Case No. 295 of 2018.
