The petitioner is languishing in custody since 02.04.2016 in connection with Nautan (Jagdishpur) P.S. Case No. 73 of 2016 for the offences instituted under Sections 467, 468, 471, 420, 406, 120(B), 341, 448 and 504 of the IPC.
It is alleged that the informant paid Rs. 92,000/- to the petitioner for providing government job but neither the job was provided to the informant nor money was returned. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.04.2016 and the charge sheet has been submitted in the present case. There is no allegation of
Patna High Court Cr.Misc. No.25814 of 2016 (3) dt.16-08-2016 2/2 tampering of the witnesses alleged against the petitioner. He has been made accused in the present case due to mistake of fact. The allegation made in the F.I.R. is denied by learned counsel for the petitioner. It is further submitted that the petitioner is ready to deposit an amount of Rs. 15,000/- in the court below which shall be subject to final disposal of the case.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit an amount of Rs. 15,000/- in the court below which shall be subject to final disposal of the case and on doing so, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., West Champaran, Bettiah, in connection with Nautan (Jagdishpur) P.S. Case No. 73/2016.
