JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 This application, for grant of anticipatory bail, arises out of Hawai Adda P.S. Case No. 128 of 2019, disclosing offences under Sections 323, 341, 326, 506 and 34 of the Indian Penal Code.

Prosecution case is that while the informant was on her home, petitioner, who is cousin brother in law of the informant and others came and slapped her, causing injury on her ear and reason behind the occurrence as per F.I.R. is that the dispute with respect to septic tank.

Submission of learned counsel for the petitioner is that a large number of cases are going on between the parties and they are close relatives. Further submission is that no specific allegation has been attributed to the petitioner though it

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -1st Class, Patna, in connection with Hawai Adda P.S. Case No. 128 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
