The petitioner being husband of the informant is languishing in custody since 12.04.2016 in a case registered for the offences punishable under sections 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.
It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant but the petitioner filed Hindu Marriage Act Petition No.1374/2015 before the Principal Judge, Family Court, West, Tis Hazari Courts, New Delhi on 24.08.2015 with a prayer for divorce and thereafter the present case was lodged on 03.09.2015.
