JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 379, 411 and 34 of the Indian Penal Code. Allegation against the petitioner is that he along with other accused persons committed theft of the buffaloes from the house of the informant.
It has been submitted on behalf of the petitioner that he is in custody since 22.2.2016. Chargesheet has been submitted against the petitioner. Petitioner has got no criminal antecedent. No allegation of tampering of witnesses is alleged against the petitioner. Petitioner is the owner of the vehicle on which the theft cattle are said to have been recovered. Petitioner has the transportation business. He had no knowledge that the cattle in question were theft cattle.
On behalf of the State, it is submitted that petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.25868 of 2016 (3) dt.16-08-2016 2/2 amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case no. 39 of 2016.
