JUSTICE MADHURESH PRASAD ORAL ORDER 09-02-2021 Counsel for the petitioner submits that the petitioner would be preferring a review under Section 13 of the Bihar Public Land Encroachment Act (hereinafter referred to as "the Act") against the order of the District Magistrate, Begusarai, dated 04.09.2020. He submits that the petitioner should be given a reasonable opportunity of being heard.
The submission of the counsel for the petitioner is countered by the learned State Counsel, who submits that no such order would be required in view of the mandate under Section 13 of the Act giving the parties reasonable opportunity of being heard.
In view of the submissions of the rival parties, the
Patna High Court CWJC No.1248 of 2021(2) dt.09-02-2021 2/2 application is disposed of with liberty to the petitioner to avail the remedy of review, in accordance with law. In view of specific contemplation of giving reasonable opportunity of hearing under the Statute, this Court need not reiterate the same.
This Court would expect that the petitioner's counsel would honour his undertaking in the instant proceedings regarding supply of the requisite court fee etc. within two weeks from the date he is called upon to do so by the office. (Madhuresh Prasad, J) PNM U
