The petitioner seeks bail in Kotwali P. S. Case No. 377 of 2016 instituted for the offence under Section(s) 8/20(b)(ii) (A) of the N.D.P.S. Act.
Learned counsel for the petitioner has submitted that petitioner has been remanded in this case by the police on 13.5.2018 after being released on bail on 23.12.2016 on the basis of the order passed by this Hon'ble High Court on 20.12.2016 in East Colony P.S. case no. 47 of 2016.
In the written report it is alleged that while the petitioner was lodged in custody with regard to aforesaid East Colony P.S. case no. 47 of 2016 one Kunal Kumar who is relative of this petitioner came at jail to give meal and when meal was
Patna High Court Cr.Misc. No.51554 of 2018(2) dt.27-09-2018 2/2 searched 100 grams of ganja was recovered from the tiffin box. Thereafter, the instant case has been filed. Learned counsel for the petitioner has submitted that petitioner was not remanded in this case while he was in custody in connection with East Colony P.S. case no. 47 of 2016. He has no knowledge about the instant case when he was released on bail on 23.12.2016 on the basis of the order passed by this Hon'ble High Court on 20.12.2016 in East Colony P. S. case no. 47 of 2016.
Petitioner has no concern with the aforesaid Ganja which is alleged to have been brought by Kunal Kumar in the tiffin box.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Munger, in connection with Kotwali P. S. Case No. 377 of 2016, G.R. No. 2235 of 2016 subject to the condition that both the bailers shall be the close relative of the petitioner.
