This application for anticipatory bail arises out of Palasi P.S. Case No. 131 of 2019 (G.R.No.1496/2019), disclosing offences under Sections 116, 118 and 120(B) of the Indian Penal Code, including Sections 25(1-B)a and 26 of the Arms Act.

Learned counsel, appearing on behalf of the petitioner, has submitted that Sections 25(1-B)a and 26 of the Arms Act have been levelled against the petitioner only on the allegation of recovery of five live cartridges. It has been stated that another case has also been registered against him being Palasi P.S. Case No. 130 of 2019, which also arises out of the same occurrence/transaction.

Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Palasi P.S. Case No. 131 of 2019 (G.R.No. 1496/2019), subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
