JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) Bihar Excise (Amended) Act 2016 and Sections 272, 273/34 of the I.P.C. Petitioner was caught by the informant while he was fleeing from a wine godown and thereafter, he accepted that he was selling foreign liquor. The godown of accused was raided and in huge quantity I.M.F.L was recovered.

Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Riga P.S. Case No. 73 of 2016 (G.R. No.919 of 2016) pending in the court of Additional Chief Judicial Magistrate-III, Sitamarhi stands rejected.
