JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(a) of Bihar Excise (Amendment) Act, 2016.
Six litres country made liquor were recovered from the house of the petitioner.
Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail at this stage and hence, his prayer for bail in connection with Excise Case No. 53 of 2016 pending in the court of Additional Chief Judicial Magistrate, Sherghati, Gaya stands rejected.
