The petitioner apprehends his arrest in connection with Nanpur P.S. Case No.98 of 2019 registered under Sections 414/34 of the Indian Penal Code.

The accusation is that in course of checking of the vehicle by the informant and other police personnel, four persons were seen on white colour Apachi Motorcycle without registration number. On giving the signal to stop the motorcycle, all started to flee away leaving the motorcycle but on chase, one person was apprehended, who disclosed his name as Rahul Kumar. On query, he did not give satisfactory reply regarding the motocycle but disclosed that the seized

Patna High Court CR. MISC. No.48333 of 2019(2) dt.05-08-2019 2/2 motorcycle is of Arun Kumar, son of Devnarayan Bhagat, resident of Maldi Tola Bhasar, P.S. Sitamarhi, which is stolen motorcycle. He also disclosed the name of his three associates, namely, Deepak Kumar, Golu Kumar alias Amol (petitioner) and Md. Mustfa Ahmad Azad alias Babbu, who succeeded to flee away.

Learned counsel for the petitioner submits that the petitioner was not apprehended on the spot rather his name has been disclosed by the apprehended accused Rahul Kumar. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Nanpur P.S. Case No.98 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
