2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 103, 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., on 09.04.2025, informant along with her husband had gone to her maternal house to attend marriage of her niece. It is alleged that on 11.04.2025, this petitioner along with other F.I.R. named accused persons took husband of the informant to their house and made him drink excessive wine due to which he died and later, his dead body was recovered from the house of this petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case due to village politics. Petitioner never served drink to the

Patna High Court CR. MISC. No.53781 of 2025(2) dt.18-08-2025 2/2 deceased, as a matter of fact, petitioner himself was a drunkard and died due to excessive consumption of wine. Petitioner claims clean antecedent.

5. Considering the fact that petitioner is named in the F.I.R. and he took husband of the informant to his house and thereafter, his dead body was found in the house of this petitioner, prayer for anticipatory bail of the petitioner is refused.
