The petitioner apprehends his arrest in Baheri P.S. Case No. 75/2016, registered for the offences punishable under Sections 188, 120(B) & 34 of the Indian Penal Code and 47(G) of the Bihar Excise Act.
The informant got information from Chandrajeet Singh that huge quantity of liquor was kept in brick kiln. The informant recovered 5408 bottles of country made liquor, each containing 400ml. It is alleged that Ashutosh Kumar Jha is a licensee of country made liquor and the licensee was asked not to sell liquor after coming into force of the new Excise Act. It is alleged that Ashutosh Kumar Jha and his men, namely Basant Chaudhary, Pappu Singh, Santosh Jha and Ghanshyam Chaudhary might have kept the liquor.

There is no eye-witness of the occurrence. The petitioner is not a licensee. Considering the facts aforesaid, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate V, Darbhanga in connection with Baheri P.S. Case No. 75/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
