The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,325,307,504 and 354A/34 of the IPC.

The prosecution case as per the Fardbeyan of Saroj Kumar Singh recorded by S.K. Singh, ASI at Anugragh Magadh Medical College Hospital is to the effect that on 9.3.2019 at 8.20 A.M. the informant was at his house along with his father and family members, in the meantime, the accused persons variously armed with iron rod and lathi entered into the house of the informant and started abusing. It is specifically alleged that

No.48265 of 2019(2) dt.02-08-2019 2/3 co-accused Sanjay Singh assaulted with iron rod causing bleeding injury on the head of the informant and thereafter when the father of the informant came to rescue, he was also assaulted. It is further alleged that co-accused Sushila Devi also assaulted the informant with brick.

It is submitted by learned counsel for the petitioners that the accusation of assault against the petitioners is omnibus and general and except one injury on the hand of the informant other injuries have been found to be simple in nature. It is further submitted that for the occurrence of 9.3.2019 the FIR was registered on 15.3.2019. Statement has been made in paragraph 3 of the petition that the petitioners are not having any criminal antecedent.

Learned counsel for the informant submits that the petitioners also made assault and one of the injuries of the informant has been found grievous.

Considering the delayed recording of the Fardbeyan and registration of FIR i.e. after three days of the occurrence, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM
