The petitioner apprehends his arrest in a case registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, all the accused persons including petitioner fraudulently sold the land of the informant in favour of Vikash Kumar. It is further alleged that when informant protested, the accused persons made firing and snatched cash of Rs. 10,000/- and gold chain from possession of the informant.

It is submitted that informant has already filed a Title Suit No. 12 of 2002 and in that suit, husband of the co-accused

Patna High Court CR. MISC. No.51831 of 2022(2) dt.19-12-2022 2/2 Manju Devi is also a party and the said title suit is pending before the Court of Sub-Judge Ist, Patna City. Dispute is of civil nature. Both parties are Gotias. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, Patna in connection with Fatuha P.S. Case No. 42 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
