The Petitioner seeks quashing of the order of cognizance dated 28.8.2010 in Complaint Case No. 476 of 2010, Trial No. 4012 of 2011 by the Judicial Magistrate, 1st Class-cum-Additional Munsif, Siwan.
In the nature of allegation, notices had been issued to the Opposite Party No. 2 but the Complainant could not be reached. Since it would be unreasonable to quash the Proceeding taking a one sided view, the application is disposed off with liberty to the Petitioner to raise all these points at the relevant stage. The Court below is also directed to take steps for ensuring attendance of the Complainant so that the matter can be sent
Patna High Court Cr.Misc. No.18834 of 2011 dt.30-03-2015 2/2 to the Mediation Centre at his level to finally settle the dispute. With this observation, the application stands disposed off.
