The petitioner is languishing in custody since 24.02.2016 in connection with Purnahia P.S. Case No. 87 of 2015 for the offences instituted under Section 395 of the IPC. The prosecution story, in brief, is that the motorcycle of the informant was snatched away by some unknown miscreants by throwing chilli powder over his face.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.02.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. He is not named in the FIR. The
Patna High Court Cr.Misc. No.23666 of 2016 (4) dt.17-09-2016 2/2 petitioner has not been put on T.I. Parade. The alleged motorcycle is said to have been recovered from joint possession of the house of the petitioner. He had no knowledge regarding the motorcycle being a stolen one.
On behalf of the State, it has been submitted that the name of the petitioner has come in course of investigation. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Sheohar, in connection with Purnahiya P.S. Case No. 87/2015. U.K./- (Sudhir Singh, J) U T
