The petitioner, who is in custody since 21.03.2019, seeks bail in connection with K. Hat (Madhubani) P. S. Case No. 186 of 2019 dated 17.03.2019 instituted for the offences under Sections 302 and 34 of the Indian Penal Code and Section 27 of the Arms Act, 1959.

The petitioner is not named in the F.I.R. The son of

The informant has named some of the persons with whom the deceased had some altercations in the past. During the course of investigation, one Shantav Ranjan Singh @ Sagar Kumar was arrested, who gave his confessional statement implicating other accused persons including the petitioner. The other material which has been collected against the petitioner during the course of investigation is the call detail report which indicates that the petitioner had talked with two other co-accused persons on telephone. Considering the aforesaid materials, two of the other accused persons, similarly situated, have been granted bail by a Bench of this Court vide orders dated 06.08.2019 and 29.07.2019 passed in Cr. Misc. Nos. 48958 of 2019 and 46392 of 2019 respectively.

Taking into account the aforesaid facts as also the clean antecedents of the petitioner, this petition is allowed. The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like
