JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 385 and 387 of the Indian Penal Code and Section 25 (1-B)A and 26 of the Arms Act. One country made loaded katta and thirteen live cartridges are said to have been recovered from conscious possession of the petitioner.
Regard being had to the facts and circumstances of the case as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Kurtha P.S. Case No. 52 of 2016 pending in the court of Chief Judicial Magistrate, Arwal stands rejected. (Hemant Kumar Srivastava, J) Mishra/- U T
