JUSTICE RAKESH KUMAR ORAL ORDER 20-08-2016 Heard Sri Chandra Mohan Jha, learned counsel for the petitioner and Sri Abhay Kumar Roy, learned A.P.P. The sole petitioner who is in custody in Isuapur P.S. Case No. 164 of 2015 registered for the offence under section 302/ 34 of the Indian Penal Code corresponding to Sessions Trial No. 291 of 2016 has prayed for grant of bail. Learned counsel for the petitioner by way of referring to the F.I.R. submits that on land dispute in the own family the occurrence had taken place and petitioner has been made accused. After going through the F.I.R. and material available on record it is evident that accusation against the petitioner is that he is the main assailant.
In view of the fact that petitioner is the main assailant
Patna High Court Cr.Misc. No.34643 of 2016 (2) dt.20-08-2016 2/2 there is no reason to extend the privilege of bail. The petition stands dismissed.
Learned counsel for the petitioner submits that in this case charge has already been framed.
In view of the fact that charge has already been framed while dismissing it is desirable to observe that the learned court below may take steps so that trial may come to its logical end without unnecessary delay.
